Terms of Service

Important Notice

PLEASE READ THESE TERMS OF SERVICE CAREFULLY, INCLUDING OUR PRIVACY POLICY.

This Terms of Service ("Agreement") is a legally binding agreement between the Association of Civil Engineering Students ("ACES," "we," "our," or "us") and you ("you" or "User").

This Agreement governs your use of or access to:

  • The official ACES portfolio website
  • Academic tools (including "Builders Progress")
  • Events and activities
  • Any other online initiatives provided by ACES

(collectively referred to as the "ACES Services").

All ACES Services are developed and maintained in-house by ACES. Source repositories are used for internal development workflows and are not released as open-source software.

ACES is headquartered at the FEU Institute of Technology, P. Paredes St., Sampaloc, Manila, Philippines.

Agreement Acceptance

By accepting this Agreement:

  • You agree to ACES rules and policies incorporated into this Agreement, including our Privacy Policy, which explains how we collect, protect, and store your information.
  • You acknowledge that your use of ACES Services is at your own risk, and that ACES liability is limited as described in Section 8.

You may not submit any information or use ACES Services if you:

  • Do not agree to this Agreement
  • Are not at least 18 years old or of legal age to form a binding contract
  • Are prohibited from accessing or using ACES Services by applicable law

By browsing our websites, accessing online tools, or using any ACES Services, you confirm that you have read, understood, and accepted all terms of this Agreement.

If you do not agree with any part of this Agreement, do not use the ACES Services.

1. Nature of the Organization

You acknowledge that ACES is a non-profit, student-run academic organization at the FEU Institute of Technology.

ACES Services, including:

  • organization resources
  • the Builders Progress tool

are provided for educational purposes only.

They do not constitute professional engineering, academic, or institutional advice.

2. License Grant & License Conditions

License Grant

ACES grants you a personal, limited, revocable, non-exclusive, non-transferable license to use the ACES Services solely for personal and non-commercial educational purposes.

License Conditions

You agree that you will not, directly or indirectly:

i. Post Inappropriate Content

Publish or transmit content that is:

  • obscene
  • vulgar
  • pornographic
  • sexually explicit
  • offensive or objectionable

ii. Interfere with Services

Develop or distribute software, scripts, plugins, or applications that interfere with:

  • ACES Services
  • hosting providers (such as Vercel)

iii. Attempt Unauthorized Access

Use illegal or inappropriate methods such as:

  • hacking
  • cracking
  • extracting source code
  • uploading malicious software

including files containing:

  • viruses
  • worms
  • Trojan horses
  • corrupted files
  • harmful programs

iv. Violate Applicable Laws

Use, export, or interact with the ACES Services in violation of applicable laws or local regulations.

3. Local Storage and Data Responsibility

As explained in our Privacy Policy, tools such as Builders Progress process and store user data locally in your browser.

ACES:

  • does not collect
  • does not transmit
  • does not store

this input data on its servers.

Because your academic data is stored entirely on your own device, you are solely responsible for managing it.

ACES is not responsible for loss of data, including if:

  • your device is damaged or lost
  • browser storage is cleared
  • browser cache is reset

4. Security and Responsible Disclosure

ACES prioritizes the security of its platforms.

If you discover a bug, vulnerability, or security issue, you agree to practice responsible disclosure.

Please report issues privately to:

feutechaces.main@gmail.com

You agree not to:

  • exploit vulnerabilities
  • publicly disclose vulnerabilities
  • distribute vulnerabilities to third parties

until the issue has been properly addressed.

5. Ownership / Intellectual Property

All ACES Services are protected by applicable intellectual property laws.

This includes:

  • website branding
  • ACES and FEU Tech logos
  • visual themes
  • design concepts
  • graphics and artwork
  • proprietary software logic for tools such as Builders Progress

For clarity, no license is granted to copy, redistribute, sublicense, or publish ACES source code outside authorized ACES channels.

Any reproduction, redistribution, or derivative use of these materials requires prior written consent from ACES.

6. Inappropriate User Behavior

Users are prohibited from:

  • impersonating ACES officers
  • spreading false information about ACES
  • posting illegal content or websites
  • sending spam or advertisements
  • threatening, attacking, or insulting other users

ACES reserves the right to restrict or terminate access for violations.

7. Indemnification

You agree to defend, indemnify, and hold harmless ACES and its:

  • student officers
  • faculty advisers
  • affiliated members
  • FEU Institute of Technology

from any claims, damages, liabilities, or expenses arising from:

  1. your use of ACES Services
  2. your breach of this Agreement
  3. materials or information submitted by you

8. Limitation of Liability

Your use of ACES Services is at your own risk.

ACES Services are provided "as is" and "as available".

To the fullest extent permitted by law, ACES and its officers, advisers, and members disclaim all warranties, including:

  • merchantability
  • non-infringement
  • fitness for a particular purpose
  • uninterrupted or error-free service

ACES is not responsible for:

  1. errors or inaccuracies in the website or tools (including Builders Progress)
  2. service interruptions or downtime
  3. malware, viruses, or malicious links introduced by third parties

9. Governing Law & Dispute Resolution

This Agreement is governed by the laws of the Republic of the Philippines, excluding conflict-of-law principles.

In the event of a dispute, both parties agree to first attempt informal resolution by contacting ACES directly.

10. Modification of Terms

ACES reserves the right to amend or update this Agreement at any time without prior notice.

Users are encouraged to review the Terms periodically.

Your continued use of ACES Services after changes are made constitutes acceptance of the updated Agreement.
